Important: Listing your home does not stop or postpone a foreclosure; only your lender, a court, or a legal process can change the sale date. Talk to your lender and a HUD-approved counselor right away.
Free help is available: a HUD-approved housing counselor can review your options at no cost — call (800) 569-4287 or find one at hud.gov/findacounselor. I never charge an upfront fee. In California, upfront fees for loan-modification or foreclosure-relief help are illegal — if someone asks for one, walk away.
What paperwork should I gather in the first week?
Foreclosure files move on dates, so collect the documents that set those dates and the numbers behind them:
- Every notice you have received, in date order, to review with a California attorney.
- A written reinstatement figure and a written payoff figure from your loan servicer.
- Your counseling appointment. HUD-approved counselors work at no charge; book through HUD's counselor search or (800) 569-4287.
- A list of the servicer's options, requested in writing: catching up, a repayment plan, forbearance, a modification or a short sale.
- The property file: permit history, any prior inspection reports, and insurance details.
Selling is one path on that list, and the attorney and counselor help you weigh it against the others.
Which offers of "help" should an Echo Park owner refuse?
Any that start with your money. Refuse anyone who wants a payment before doing anything, who tells you to stop paying the servicer or to send mortgage payments to them, or who asks you to sign the deed over. The CFPB lists these as common foreclosure-relief scam signs, and the California DRE explains the state's advance-fee rules.
What can slow an Echo Park sale when the calendar is tight?
Older hillside houses tend to raise the same handful of questions, and each can add days:
| Possible delay | How to get ahead of it |
|---|---|
| Natural hazard questions | City and State maps show landslide and liquefaction zones over smaller parts of the Echo Park area; run the address through EQ Zapp and order the disclosure report early |
| Brush clearance | Parts of Echo Park are mapped as a Very High Fire Hazard Severity Zone, but not every street is. Check the specific parcel on ZIMAS or the CAL FIRE map, and confirm with the natural hazard disclosure in escrow. Inside that zone, LAFD's clearance rule reaches 200 feet out from structures |
| Additions without permits | Pull the LADBS permit record so buyers' questions are answered from the file |
| Access for inspectors and appraisers | Long stairs and tight street parking take planning; share access notes with every visitor |
| Showings on fire-weather days | Some hillside streets have posted Red Flag No Parking signs; on declared Red Flag Days, cars parked there are towed. The City's layer lists posted segments on Peru Street and Landa Street, among others; check lafd.org/redflag |
| The City report | Order the Residential Property Report in the first week; see the costs below |
A buyer paying without a loan may close sooner, but no timing is assured and the trustee's sale date can still come first. Keep your servicer and counselor updated as escrow moves.
How does escrow handle the loan at closing?
Escrow requests a payoff demand from the servicer and pays it, along with other recorded liens, from the sale funds. If the price falls short of the total, the servicer would have to approve taking less, which is a short sale; your attorney can explain what that would mean for you.
What closing costs come out of a pre-foreclosure sale?
The standard ones, taken from the proceeds. LA County's documentary transfer tax is $1.10 per $1,000 of the sale price; some cities add their own tax, and your escrow estimate shows the exact figure. For qualifying transactions closing after June 30, 2026, Los Angeles Measure ULA imposes an additional 4% tax when the value conveyed exceeds $5,400,000 but is below $10,900,000, or 5.5% when the value conveyed is $10,900,000 or more. The applicable ULA rate is calculated on the full gross value conveyed, not just the amount above the threshold. The City's 0.45% base transfer tax and the County documentary transfer tax are separate charges. Confirm the calculation and any applicable exemptions with your escrow officer.
LADBS requires the seller of residential property in the City of Los Angeles to give the buyer a Residential Property Report before the sale or the close of escrow (LAMC Section 96.300; $70.85 per report as of November 4, 2026). The LADBS Form 9 application says no new report is needed for six months after one is issued, and it lists exceptions, including property exempt from the documentary transfer tax and the first sale of a home in a subdivision whose final map was recorded not more than two years earlier. Check your transfer with LADBS before ordering.
The amount or rate of real estate commissions is not fixed by law. They are set by each broker individually and may be negotiable between the seller and broker.
What to bring to your CPA or attorney: every notice from the lender, the payoff and reinstatement letters, the escrow estimate, and any IRS forms the lender sends after closing.

Questions
Echo Park foreclosure questions
- If I put my Echo Park house on the market, is the foreclosure paused?
- No. Listing does not stop or postpone it. The sale date changes only through your lender, a court or a legal process.
- After a notice of default, is selling still possible?
- It may be, when escrow can close ahead of the trustee's sale. Reach out to your servicer, a HUD-approved counselor and an attorney this week.
- Who offers free foreclosure counseling near Echo Park?
- HUD-approved housing counselors, at no charge. Phone (800) 569-4287 or use hud.gov/findacounselor.
- Is it legal to charge me before helping with my loan?
- In California, upfront fees for loan-modification or foreclosure-relief help are illegal. Decline and report the request.
- Can a buyer close before my trustee's sale date?
- Sometimes, though nothing is assured. Financing, inspections and paperwork set the pace, and a buyer paying without a loan may close sooner.
- What happens if the sale price will not cover my loan?
- The servicer would have to accept less, which is a short sale. Your attorney and a HUD-approved counselor can tell you whether it fits.
- Do older Echo Park houses need repairs before a quick sale?
- Rarely much. Required brush clearance, early disclosures and clear access for inspectors usually matter more when time is short.
- How does your home value review fit in?
- It is my opinion of value from comparable nearby sales, not an appraisal. Set it beside the payoff figure to see whether a sale could work.
