What Does the October 22, 2026 Housing Cost Executive Order Change?

The October 22, 2026 executive order "Decreasing Housing Costs for the American People" conditionally directs FHFA to pursue a mortgage insurance cancellation pilot for new loans and a wider title alternative on some refinances, directs USDA and VA to reduce direct-loan rates within their legal authority and available appropriations, and creates a manufactured-housing task force. As of October 23, 2026, nothing has changed for borrowers.

What is the difference between judicial and nonjudicial foreclosure in California?

In California, a judicial foreclosure goes through court and a nonjudicial foreclosure does not. California Courts Self-Help explains that if the mortgage or deed of trust has a power of sale clause, a lender can use nonjudicial foreclosure, which is the most common type in California.

How do we sell the house during a divorce in California?

Once a divorce petition is filed and the petition and summons are served in California (or service is waived), the restraining orders in the summons under Family Code section 2040 bar both spouses from transferring or disposing of property without the other spouse's written consent or a court order, except in the usual course of business or for the necessities of life. The California Courts say that until you have a court order, property or debt from your marriage "still belongs to both of you".

Can I sell my house with tenants in it in California?

Yes, you can list a rented home, and the state's just-cause list for ending a tenancy in Civil Code section 1946.2 doesn't include a sale. You can sell with the tenant in place or end the tenancy only for a listed reason with any relocation owed, and Pasadena and unincorporated LA County add their own rules.

How do heirs sell a house with a reverse mortgage in California?

When the last borrower on an FHA reverse mortgage (HECM) dies, the loan becomes due, and under HUD's rule heirs get 30 days from the lender's due-and-payable notice to pay it off, sell, or give the home to the lender. Extensions may be approved while the home is actively marketed, and if the balance is more than the home is worth, HUD says a sale for at least 95% of the appraised value can satisfy the loan.

What if siblings disagree about selling an inherited house in California?

When co-owners of an inherited California house can't agree, they can try a buyout or an agreed sale first, and if that fails, a co-owner may ask a court to partition the property. For tenancy-in-common cases filed on or after January 1, 2023, the Partition of Real Property Act in the Code of Civil Procedure calls for a court valuation and a chance for co-owners to buy out those seeking a sale, and a court-ordered sale is generally an open-market sale through a licensed broker.

Lost your Altadena home in the Eaton Fire? Can Prop 19 move your tax base when you sell?

If the Eaton Fire substantially damaged or destroyed the Altadena home you lived in, Prop 19 may let you sell it in its damaged state and move its taxable value to a replacement home anywhere in California that you buy or build within two years of the sale. You file form BOE-19-V with the Assessor of the county where the new home is, and the Assessor decides whether you qualify.

How do I sell a house held in a living trust after a parent dies in California?

When a parent's house is titled in their living trust, the successor trustee can generally sell it under the trust's terms without court authorization, unless the trust limits that power. Before listing, a trustee in Los Angeles County typically records an affidavit of death of trustee with the Registrar-Recorder, notifies the County Assessor within 150 days of the death, and serves the beneficiaries and heirs the notice the Probate Code requires, with an estate attorney confirming the steps for your trust.
