Can an heir keep the parent's tax base?
Under Proposition 19, a child who makes the home a primary residence may keep part of the parent's taxable value, within limits, and must file with the County Assessor. Renting it out does not qualify. Rules as of October 15, 2026; ask a California attorney or CPA before deciding.
What if the family rents it out?
The heirs become landlords. Statewide rent cap and just-cause rules under the Tenant Protection Act (Civil Code section 1947.12) may apply depending on the property and ownership; ask counsel which apply before signing a lease.
