Which sale path applies to a South Pasadena probate home?
Under the Independent Administration of Estates Act (Probate Code section 10400 and following), a personal representative granted full authority can sell estate real property without court confirmation after delivering a Notice of Proposed Action at least 15 days before the date set for the sale (Probate Code section 10586). If an heir or beneficiary delivers a timely written objection, the sale must go through court supervision instead (Probate Code section 10589). Ask the estate’s attorney which path the court order allows.
Full or limited IAEA authority: how does it change a South Pasadena sale?
The order that issues letters states whether the personal representative holds full or limited authority under the Act. Limited authority is not enough to sell the house alone: Probate Code section 10501(b) lists a sale of real property among the steps that still require court supervision. Full authority lifts the court-confirmation requirements from the sale, including published notice of sale, court approval of the agent’s commission and the 90 percent of appraised value minimum (Probate Code section 10503). The amount or rate of real estate commissions is not fixed by law. They are set by each broker individually and may be negotiable between the seller and broker. The estate’s attorney reads the order and tells the family which one it is.
How do the 90 percent floor and overbids work when the court confirms a South Pasadena sale?
For a private sale the court must confirm, the house needs an appraisal made, with a valuation date, within one year before the confirmation hearing, and the accepted offer has to reach at least 90 percent of that appraised value (Probate Code section 10309). At the hearing, a higher written offer can be made, and Probate Code section 10311 says the court accepts it if it exceeds the original bid by at least 10 percent of the first $10,000 plus 5 percent of the amount over $10,000. Buyers should expect that possibility when they make an offer. Ask the estate’s attorney about hearing dates.
Is there a shorter court path for a South Pasadena primary residence up to $750,000?
Sometimes. When the house was the decedent’s primary residence in California and the death occurred on or after April 1, 2025, through March 31, 2028, a successor can petition the Superior Court for an order transferring that home if its gross value is no more than $750,000, without letters and once 40 days have passed since the death (Probate Code sections 13151 and 13152(f)(3)). This route is available only when no proceeding to administer the estate is being or has been conducted in California, or when the personal representative has consented in writing to this procedure (Probate Code section 13152(a)(5)). A probate referee appraises the home for the petition (Probate Code section 13152(b)). The California Courts Self-Help Guide notes that Assembly Bill 2016 raised the figure to $750,000 and limited the procedure to the main home. The estate’s attorney decides whether this route fits the family.
How should a South Pasadena estate home be priced and prepared?
Sidney Manzo walks through the house first, then sets a list price from recent sales of South Pasadena homes with a similar lot, size and condition, so a dated kitchen is measured against other dated kitchens. Preparation usually means clearing belongings, a deep clean, yard work and paint; larger repairs are weighed against what they would add to the price. Photos are scheduled after the clean-out so the listing shows the rooms rather than their contents. The personal representative approves each cost, and the estate’s attorney receives the plan.
Does South Pasadena review exterior work before a sale?
It can, if the parcel is on the City’s Inventory of Historic Resources. The City of South Pasadena says a Certificate of Appropriateness is required for exterior alterations, new construction and demolition affecting properties listed on its Inventory of Historic Resources, while painting and routine maintenance are exempt; applications are heard by the Cultural Heritage Commission at a public hearing, held on the third Thursday of each month (South Pasadena Municipal Code section 2.65; southpasadenaca.gov, accessed October 15, 2026). Before the estate replaces windows, doors, a porch or other exterior features ahead of a sale, ask the Planning Division whether the parcel is on the inventory. Cleaning and paint can start while that is checked.
Which county court and recording rules apply?
Probate for a South Pasadena estate runs through the Los Angeles Superior Court. To find out whether a case has been opened, the court’s Probate Division points to its online case search or to the Stanley Mosk Courthouse, 111 N. Hill St., Room 429, and asks for the decedent’s full name and date of death (lacourt.org, accessed October 15, 2026). When the deed records, the LA County Registrar-Recorder collects documentary transfer tax at 55 cents per $500 of value, the same as $1.10 per $1,000; only Culver City, Los Angeles, Pomona, Redondo Beach and Santa Monica add a city rate, so South Pasadena has none (lavote.gov, accessed October 15, 2026). Ask your escrow officer or a real estate attorney who pays the transfer tax under your purchase contract.
What is specific to South Pasadena?
The City of South Pasadena says it was incorporated on March 2, 1888, covers 3.44 square miles, and has more than 21,000 street trees, which is why it is known as the City of Trees; its boundaries were set in 1889 and are essentially unchanged (accessed October 15, 2026). City Hall is at 1414 Mission Street, South Pasadena, CA 91030 (southpasadenaca.gov). South Pasadena is a separate city from Pasadena, so confirm the city on the parcel and ask the City’s Planning Division about zoning for the specific address.

Questions
What do South Pasadena heirs ask about probate home sales?
- Who can sign the listing for a South Pasadena probate home?
- The personal representative the court appoints signs for the estate, within the authority the court grants under the Probate Code. That may not be the family member who lived in the house. Ask the estate’s attorney to confirm the authority in the court order before anyone signs a listing agreement, so the sale is not delayed later. A property-specific review can start while the attorney confirms it.
- Can I list a South Pasadena estate home before probate is final?
- Often, yes, once the Los Angeles Superior Court has issued letters. The case does not have to be closed; the house can be prepared and listed once the court has appointed the personal representative and issued letters. How the sale closes depends on the order: full authority under the Independent Administration of Estates Act uses a Notice of Proposed Action (Probate Code section 10586), and limited authority needs court supervision (Probate Code section 10501). The estate’s attorney confirms the timing for your estate.
- Do we have to fix the South Pasadena house before a probate sale?
- No. Many estate homes sell in their current condition, priced for it. Sidney Manzo suggests only low-cost work that changes how buyers see the house, such as a clean-out, yard care and paint. If the property is on South Pasadena’s Inventory of Historic Resources, exterior alterations need a Certificate of Appropriateness first, so larger exterior repairs are often left to the buyer. Disclosure duties still apply; ask the estate’s attorney which forms the estate provides.
- Can heirs object to the probate sale of a South Pasadena home?
- Yes. Under Probate Code section 10587, a person who receives a Notice of Proposed Action can deliver a written objection to the personal representative, and a timely objection means the sale must go through court supervision under Probate Code section 10589. Ask the estate’s attorney how the objection deadline is set for your estate before you plan a closing date.
- What is an overbid at a South Pasadena probate confirmation hearing?
- At a Los Angeles Superior Court confirmation hearing on a South Pasadena sale, Probate Code section 10311 lets the court accept a higher written offer that exceeds the original bid by at least 10 percent of the first $10,000 plus 5 percent of the amount over $10,000. The original buyer can lose the home to that higher bid. Ask the estate’s attorney whether your sale will need a confirmation hearing.
- How is a South Pasadena estate home priced?
- Pricing starts with the specific house: lot, condition, layout, updates and recent sales of similar homes nearby. A citywide figure is context only, and an estate home that needs work is compared with sales of homes in similar condition. A property-specific review is an opinion of likely price for planning. It is not an appraisal and does not promise a result.
- Does asking for a review of a South Pasadena estate home list it for sale?
- No. A review or a consultation is not a listing agreement. A listing starts only when the person with authority to sell signs a written listing agreement that sets the services, the term and the compensation. You can ask questions about the house, the likely price range and the timing first, and decide later whether to list at all.
