Important: Listing your home does not stop or postpone a foreclosure; only your lender, a court, or a legal process can change the sale date. Talk to your lender and a HUD-approved counselor right away.
Free help is available: a HUD-approved housing counselor can review your options at no cost — call (800) 569-4287 or find one at hud.gov/findacounselor. I never charge an upfront fee. In California, upfront fees for loan-modification or foreclosure-relief help are illegal, and the CFPB warns about anyone who asks for one.
What are the steps in a Silver Lake short sale?
- Call the servicer and ask whether a short sale is available on your loan, and what they need from you.
- Talk with a HUD-approved counselor and a California attorney about the short sale and the alternatives.
- Gather the hardship file: income, expenses, bank statements, the hardship letter and every lender notice.
- Get a broker opinion of price grounded in recent nearby sales.
- List and accept an offer that is expressly subject to lender approval.
- Submit the offer and file to the lender, and answer its valuation and document requests.
- Close only after written approval, on the terms the lender sets.
How does the lender decide on a Silver Lake short sale?
The lender compares your offer with what it expects the house to bring, usually through its own valuation. That is where a hillside house needs a clear file. An outside valuation can miss a steep approach, a long stair to the front door, a retaining wall that needs work, or a lot that is mostly slope. Photographs, a short condition list and recent nearby sales on similar streets help the reviewer see the house as buyers do.
| Item for the lender's review | Why it matters on a Silver Lake hillside lot |
|---|---|
| Condition list with photos | Shows repairs a buyer will price in |
| Inspection reports, if any | Documents slope, drainage or structural items |
| Permit record from LADBS | Explains any unpermitted space buyers discount |
| Zoning from ZIMAS | Shows what a buyer can and can't add |
| Comparable nearby sales | Grounds the price in streets like yours |
Do hillside and zoning rules affect a short sale price?
They can affect what buyers pay. City Planning's Baseline Hillside Ordinance (Ordinance No. 181,624) limits floor area by slope band on R1, RS, RE and RA lots in the Hillside Area, and City maps place most of Silver Lake in that area. A buyer counting on a large addition may offer less if the lot leaves little room. The City's generalized zoning map layer also shows R2 and RD multi-unit zones alongside R1 in Silver Lake, and a lot zoned for a second unit can draw different buyers. Your parcel's ZIMAS report shows its zone.
How should a Silver Lake house be prepared for a short sale?
Simply, and on the lender's timeline. Repairs are usually limited, because the lender rarely funds them. What helps most costs little:
- Brush cleared. Parts of Silver Lake are mapped as a Very High Fire Hazard Severity Zone, but not every street is. Check the specific parcel on ZIMAS or the CAL FIRE map, and confirm with the natural hazard disclosure in escrow. LAFD requires year-round clearance within 200 feet of structures in that zone.
- Rooms clean and clear, so photographs and the lender's valuation show the space.
- Access planned. Some hillside streets have posted Red Flag No Parking signs; on declared Red Flag Days, cars parked there are towed. The City's layer shows posted segments such as Riverside Place, Corralitas Drive and Fair Oak View Terrace. Check lafd.org/redflag before showings.
- Disclosures started early, using the State's EQ Zapp map for mapped landslide and liquefaction zones.
- City report ordered, so escrow isn't waiting on it once approval comes.
How long does a short sale take?
Longer than a standard sale, and the lender sets the pace. Some approvals come in weeks, others take months, and a sale date can arrive first. Keep the servicer, the counselor and your attorney informed throughout, and plan for the possibility that the lender says no.
What happens to the remaining loan balance after a short sale?
What happens to any remaining balance is a legal question. Have your attorney read the lender's approval letter before you sign. A short sale can also have tax consequences (see IRS Publication 4681), so bring your lender paperwork to your CPA before you sign.
What does a short sale cost the seller in Silver Lake?
In an approved short sale, the lender's approval sets which costs are paid from the proceeds. LA County's documentary transfer tax is $1.10 per $1,000 of the sale price; some cities add their own tax, and your escrow estimate shows the exact figure. For qualifying transactions closing after June 30, 2026, Los Angeles Measure ULA imposes an additional 4% tax when the value conveyed exceeds $5,400,000 but is below $10,900,000, or 5.5% when the value conveyed is $10,900,000 or more. The applicable ULA rate is calculated on the full gross value conveyed, not just the amount above the threshold. The City's 0.45% base transfer tax and the County documentary transfer tax are separate charges. Confirm the calculation and any applicable exemptions with your escrow officer.
LADBS requires the seller of residential property in the City of Los Angeles to give the buyer a Residential Property Report before the sale or the close of escrow (LAMC Section 96.300; $70.85 per report as of October 30, 2026). The LADBS Form 9 application says no new report is needed for six months after one is issued, and it lists exceptions, including property exempt from the documentary transfer tax and the first sale of a home in a subdivision whose final map was recorded not more than two years earlier. Check your transfer with LADBS before ordering.
The amount or rate of real estate commissions is not fixed by law. They are set by each broker individually and may be negotiable between the seller and broker.
What to bring to your CPA or attorney: the lender's approval letter, any Form 1099-A or 1099-C, the payoff statements, and the estimated closing statement.

Questions
Silver Lake short sale questions
- What is a short sale on a Silver Lake house?
- It is a sale for less than the loan payoff, which closes only with the lender's written approval.
- Will my lender approve a short sale?
- Approval is not assured. The lender reviews your hardship file, the offer and its own valuation, and may approve, counter or decline.
- Does a short sale stop a foreclosure in Silver Lake?
- No. Listing or accepting an offer does not stop or postpone a foreclosure. Only the lender, a court or a legal process can change the sale date.
- How long does a short sale take in Silver Lake?
- Usually longer than a standard sale, because the lender's review sets the pace. Weeks or months are both common.
- Do I have to repair my Silver Lake house for a short sale?
- Usually not. Clean rooms, cleared brush and a clear condition file help more than repairs the lender won't fund.
- Is there free help with a short sale?
- Yes. HUD-approved housing counselors help at no cost. Call (800) 569-4287 or search hud.gov/findacounselor.

- No. I never charge an upfront fee, and in California upfront fees for loan-modification or foreclosure-relief help are illegal.

- It may be. Bring the lender's approval letter and any tax forms to your CPA before you sign.
