# Selling a rental or investment property in California?

Investment sales differ from home sales in tenant notice, pricing on rent and tax treatment. Sidney Manzo, a San Gabriel Valley agent in real estate since 1990, lists rentals, handles tenant-occupied showings and works with your CPA. Get my free home review.

## Considering an investment property or a former home?

We can discuss the real-estate side of keeping, renting, or selling a property. Tax treatment, 1031 eligibility, insurance, and financing belong to the appropriate professionals. A conversation does not create a listing agreement or agency relationship.

## What Is an Investment Property?

An investment property is real estate you own primarily to generate income or long-term appreciation rather than to live in yourself. Common examples include:

- Rental houses or apartments
- Multi-family buildings
- Commercial properties
- Vacant land held for investment or future use — whether a particular parcel is held for investment, or held primarily for sale, is a tax question
- Vacation rentals used mainly for income rather than personal enjoyment, where that use is permitted

The key factor is often intent and actual use: the property is generally held for investment or used in a trade or business. Whether a particular property is treated that way for tax purposes is a question for a qualified tax professional. We do not make that determination.

## What Is a Primary Residence?

Your primary residence is generally the home you use as your principal place of residence. Tax rules can use specific tests depending on the issue being considered. Possible indicators may include where you spend your time, where you receive mail, where you are registered to vote, and addresses appearing on your driver’s license or tax returns. These are examples only and are not a complete tax test. We do not determine whether a property is your primary residence.

## Why the Difference Matters

The comparison below is general information about common distinctions. It is not tax, legal, insurance, or lending advice, and it does not decide how any particular property is treated.

| Aspect | Primary Residence | Investment Property |
| --- | --- | --- |
| Primary purpose | Personal residence | Investment or business use |
| Potential home-sale exclusion | May be available if applicable federal requirements are satisfied | Generally not the primary rule for an investment property |
| 1031 exchange | Generally not applicable while held primarily for personal use | May be available if applicable requirements are satisfied |
| Depreciation | Generally not available for personal residential use | May be available for qualifying rental or business use |
| Mortgage interest | Subject to applicable personal deduction rules | Different rules may apply to qualifying investment or business debt |
| Property taxes | Applicable property-tax rules for a personal residence may apply | Applicable property-tax rules depend on the property and use |
| Insurance | Coverage appropriate for owner occupancy | Landlord or commercial coverage may apply depending on use |
| Financing | Owner-occupied financing may be available | Investment-property financing may have different terms and requirements |

Whether any of these items applies to a specific property depends on the facts and applicable law. Ask a qualified tax professional, insurance professional, or lender about your situation.

## Converting a Former Home to an Investment Property

Some owners eventually move from a primary residence and retain the former home as a rental or other investment property. A change in use can have tax, insurance, financing, and property-management consequences.

- Confirm the intended change in use with your tax professional.
- Review the mortgage and any owner-occupancy requirements.
- Update insurance coverage for the property’s new use. Confirm coverage with your insurance professional before changing the property’s use.
- Establish appropriate rental or investment records.
- Track the date of the change in use and relevant income and expenses.
- Ask your tax professional how depreciation, future sale gain, and any potential 1031 exchange would be treated.

Moving out by itself does not establish that every tax requirement has been satisfied. Whether a former residence can later be treated as investment property for a particular tax purpose depends on the facts and applicable law. Your tax professional can also determine the appropriate basis and depreciation treatment when a former residence is placed in service as a rental.

## Common Mistakes to Avoid

The items below are common planning issues owners discuss with their professionals. They are not a complete list and are not instructions for any file.

- Assuming any house you own automatically qualifies as an investment property.
- Assuming that a home-sale gain exclusion and 1031 exchange treatment can automatically be combined when a property’s use changes.
- Using a personal homeowners insurance policy on a rental without confirming coverage.
- Failing to discuss reporting of rental income with a tax professional once the property is no longer used as a primary home.
- Mixing personal use and rental use without clear records.

## What a licensed real-estate professional can discuss

The distinction between a primary residence and an investment property can affect the real-estate decisions you make about marketing, financing, insurance, property management, and timing. Tax and legal consequences should be reviewed with the appropriate professionals.

- Discussing the real-estate considerations of keeping, renting, or selling a former residence
- Evaluating property condition and market position
- Preparing an advisory comparative market analysis — not an appraisal or promised sale price
- Discussing potential listing and sale timing
- Helping prepare and market a property if you later authorize a listing
- Coordinating real-estate dates with your tax professional, lender, insurance professional, or Qualified Intermediary
- Assisting with the purchase side when you separately seek representation and enter into the applicable agreements and disclosures

We do not determine tax treatment, advise whether a property qualifies for a 1031 exchange, provide legal or financial advice, hold exchange funds, or act as a Qualified Intermediary. We do not purchase properties. A conversation does not create a listing agreement or agency relationship. Results depend on the property and the market. This information is for educational purposes only and is not tax, legal, or financial advice. Rules can change, and individual situations vary. Always consult a qualified tax professional, real estate attorney, or CPA familiar with California real estate before making decisions about primary residences or investment properties.

## Questions

**Can you tell me whether my property is an investment property or my primary residence?**

No. Whether a property is held for personal use, investment, or a trade or business is a tax question for a qualified tax professional. We discuss the real-estate path only.

**Does moving out automatically convert a home into an investment property?**

No. Moving out by itself does not establish that every tax requirement has been satisfied. Ask your tax professional how a change in use would be treated.

**Can I use a 1031 exchange on a house I live in?**

A 1031 exchange generally does not apply while real property is held primarily for personal use. IRS rules generally require both the relinquished and replacement real property to be held for investment or productive use in a trade or business. Whether a property that has changed use meets the requirements for a particular exchange is a tax question for your qualified tax professional and Qualified Intermediary.

**Can you promise rental income or a cap rate?**

No. An advisory review is not an appraisal and does not promise rental income, a cap rate, a return, or a particular closing date.

**Do you act as a Qualified Intermediary?**

No. We do not hold exchange funds or act as a QI.

**Does asking for a review list the property?**

No. A conversation is not a listing agreement and is not an exchange agreement with a Qualified Intermediary.
